2. APPLICATION OF THE GENERAL CONDITIONS OF SALE

These conditions apply to the sale of products by PRAETORIAN SHOP on its shop accessible via the Internet. They are automatically made available to the buyer on the home pages of the PRAETORIAN SHOP site.

The buyer just has to click on "General Conditions of Sale" (hereinafter referred to as GTC) to know the conditions of his order, even before having started the ordering process.

Consequently, the fact of placing an order implies full and unreserved acceptance by the buyer of these GTCS, to the exclusion of all other documents such as prospectuses, catalogs issued by the seller and which have only one value. indicative.

The fact that the seller does not avail himself at a given time of any of the provisions hereof cannot be interpreted as a waiver of his subsequent recourse to any of the said conditions.

Our offers are reserved for individuals and businesses.

Orders are confirmed by sending an order confirmation email but are not final until full payment has been received.

3. HOW TO PLACE AN ORDER

- Product selection

Once the Customer has accessed the Site, he can select the Product (s) he wishes to order and thus fill his basket located at the top right of his screen. He can remove Products from his basket at any time or modify the quantities of the Products by clicking on the buttons provided for this purpose. Once the Product (s) has been selected, the Customer can validate his basket by clicking on the button "VALIDATE THE ORDER". By clicking on this button, the Customer accepts and expressly acknowledges waiving the benefit of article 1587 of the Civil Code.

- Final order process

A summary of the order appears on the screen. At this stage, the Customer always has the possibility to remove the Products from his basket or to modify the quantities of the Products by clicking on the buttons provided for this purpose. In order to definitively validate his order, the Customer is invited to accept these general conditions of sale by checking the box provided for this purpose and he must finally click on the “ORDER” button. By clicking on this button, the Customer expressly acknowledges that he undertakes to pay the amount of his order in order to receive it. The fact that the Customer clicks on his button constitutes the Customer's commitment to pay for his order.

- Order confirmation

The Customer will receive, once their order is finalized, an order confirmation email to the address indicated when creating their account. This email will confirm the essential elements of the order and in particular the product (s), the price (s) of this product (s), the delivery times and methods. This email will also remind you of the conditions under which the Customer can exercise his right of withdrawal.

7. METHOD AND TIME OF DELIVERY

Delivery is made by the carrier to the address indicated by the customer when ordering (or by a notice of availability in the absence of the customer).

 

The delivery time :

Delivery times vary by country, region and order. They run from the verification of customer data by PRAETORIAN SHOP in the event of delivery without prior payment and from receipt of payment or bank authorization in the event of delivery with prior payment (online bank card).

 

In any event, delivery must take place within a maximum period of thirty (30) days from the transmission of the order. If delivery could not be ensured within this period, the consumer would be informed as soon as possible and could cancel his order or even modify it.

He can then request a refund or a credit (valid for 60 days) to be used on a next order.

 

 

8. PAYMENT

The price of the items ordered is payable in full to PRAETORIAN SHOP, when your order form is issued on the site, according to one of the following payment methods:

- by credit card (secure online payment),

- by PAYPAL.

 

Upon receipt of your payment, we will ship the products to you with your final invoice.

1 - Internet: secure payment by credit card

We have set up a secure online payment procedure for you by credit card. This procedure is based on information encryption technology, a true benchmark in secure payment.

How to place an order by credit card on the site?

When you pay, you save your credit card numbers and their expiration date, which are immediately encrypted on your computer before being sent over the Internet. Thus, no confidential information circulates on the network without having been encrypted beforehand.

Please note: only bank cards bearing the initials CB, VISA, EUROCARD, MASTERCARD or AMERICAN EXPRESS are accepted.

9. TRANSPORTATION AND RESPONSIBILITY

The goods travel at your expense and risk. It is therefore your responsibility to check the contents of the package at the time of delivery and to make reservations, if necessary, on the delivery slip provided by the delivery person or the carrier in his presence.

 

In all cases, you must notify the company that delivered the package by registered letter AR addressed to its head office within 48 hours of receipt of the package, the complaint about the reservations made on delivery.

 

And, in all cases, send a copy to the company PRAETORIAN SHOP by letter addressed to its head office (La Guillerie 4, 85700 Saint-Mesmin) within three (3) days of receipt of the package, an email with a copy of the RAR addressed to the carrier can also be addressed.

10. RETURN OF THE PRODUCT

Pursuant to article L. 121-16 of the Consumer Code, you have the possibility to use your right of withdrawal and to return, at your expense, to the address of our head office indicated in article 1, the product within fourteen (14) days of delivery, in good condition and in its original packaging with the original invoice, for exchange or refund of an amount corresponding to the value of the returned product as well as the initial shipping costs.

Return cost coverage

PRAETORIAN SHOP will bear the return costs (at the basic rate in force) only if one of the following two conditions is met:

 

The delivery turns out to be non-compliant with the order, or you have made reservations with the carrier (see article 9: transport and liability). In this case, please contact our customer service, the contact details of which appear in article 1, for the choice of carrier.

 

 

11. RETENTION OF OWNERSHIP

Until full and effective payment of the price, PRAETORIAN SHOP remains the owner of the goods sold. Payment in full will constitute a transfer of ownership, however the buyer becomes responsible for the items upon delivery, the transfer of possession being a transfer of risk.

 

 

12. RESOLUTION OF THE CONTRACT

In the absence of payment by the customer within the agreed time limits and one month after an unsuccessful formal notice, the sale will be automatically terminated if the seller deems it appropriate, with return of the deposits paid by the buyer, and the seller can request provisional repair, return of products already delivered, where applicable, without prejudice to other damages. In the event of recovery by way of litigation, this will give rise to a fixed compensation of 15% of the amount of the order.

13. DATA CONFIDENTIALITY

Right of access and rectification

This contract is subject to French law. Any dispute arising in connection with the execution or interpretation of this contract will be brought before the court of the defendant's domicile.
